Step-by-Step Property Registration Process in Bangladesh

1. Verify the Property Title

Before proceeding with registration, ensure the seller has a clear and legal ownership title. Check the following:

  • Record of Rights (Khatian)
  • Mutation certificate
  • Tax clearance certificate
  • Registered deed history

2. Sale Agreement and Payment

Once verification is complete, the buyer and seller must sign a sale agreement (Baina Nama) on stamp paper. A certain percentage of the payment is made as an advance.

3. Prepare the Sale Deed (Dalil)

A lawyer drafts the sale deed, which must include:

  • Seller and buyer details
  • Property description
  • Sale amount and terms
  • Legal declarations

4. Stamp Duty Payment

The buyer must purchase non-judicial stamp papers equivalent to a percentage of the property value. The current stamp duty rates in Bangladesh are:

  • 1.5% Local Government Tax
  • 3% Registration Fee
  • 2% Stamp Duty
  • 1% Gain Tax (for sellers)

5. Deed Registration at the Sub-Registry Office

Both parties must visit the Sub-Registry Office to officially register the property. The following documents are required:

  • Original Sale Deed
  • Seller’s national ID card
  • Buyer’s national ID card
  • Mutation certificate
  • Land tax receipts

6. Mutation of Property Ownership

Mutation is the process of updating land records in the buyer’s name. The buyer must submit a mutation application to the Assistant Commissioner (Land) along with the registered deed. A hearing is conducted, and once approved, the buyer’s name is recorded in the Khatian.

7. Obtain the Certified Copy of the Deed

After registration, the buyer can request a certified copy of the deed from the Sub-Registry Office. This serves as proof of ownership.

8. Update Property Tax Records

The final step is to update land tax records and start paying property taxes under the new owner’s name.
